Further, it serves to clarify one's own position (legally and factually), avoidance of formalized conflict resolution by negotiated solutions and assistance in negotiations, but, if necessary, also to strategically and tactically prepare for a confrontational conflict resolution, which includes both, the clients internal organization, as well as sizing up the potential conflict partner. Mediation, Arbitration, but also filing suit before a public Court must be checked and evaluated regarding suitability in each concrete case. Mediation, is the most amicable format to resolve differences and attempts to arrive at a jointly achieved and agreed result. Not all types of conflict or targets intended to be achieved by a conflict will be suitable, also quite often either of the parties may have a dislike or distrust for this type of conflict resolution. Arbitrations, are most suitable for controversially fought, confidential topics and situations, which should not be dealt with in a public procedure. Also, the arbitrators may be appointed considering primarily the adequacy and depth of expertise. Generally, arbitrations ought to lead to a legally correct faster and at lower cost than a public court.

Nicht alle Konflikte oder mit Konflikten angestrebte Ziele eignen sich hierfür. Häufig zeigen sich aber auch Widerstände gegen deren Einsatz bei einer der Parteien. Schiedsverfahren eignen sich für kontrovers geführte, vertraulich und unter Ausschluss der Öffentlichkeit zu behandelnde Konstellationen, bei denen man das Entscheidergremium selbst, unter dem Gesichtspunkt der einschlägigen Expertise, benennen kann. Es sollte in der Regel schneller und kostengünstiger zu einem materiell-rechtlich korrekten Resultat führen.
